Under Regulation 4 of the Control of Asbestos Regulations 2012, anyone who owns, occupies, manages, or is otherwise responsible for the maintenance of a non-domestic property built before 2000 has a legal duty to manage any asbestos present. Who is a duty holder under CAR 2012?
Regulation 4 of the Control of Asbestos Regulations 2012 defines a duty holder as anyone who, by virtue of a contract or tenancy, has an obligation to maintain or repair a non-domestic building. This includes commercial landlords, property management companies, facilities managers, employers who occupy their own premises, charity trustees, school governing bodies, and housing associations. If you are responsible for the upkeep of a pre-2000 non-domestic building, you are almost certainly a duty holder.
What asbestos training do maintenance staff legally need?
Under Regulation 10 of CAR 2012, anyone who is liable to disturb asbestos through their work — or who supervises such work — must receive appropriate information, instruction, and training. For most maintenance workers and site managers, this means an accredited asbestos awareness course (Category A training). For those who carry out non-licensed asbestos work, Category B training is required. Licensed work operatives require formal Category C training. Do I need a written asbestos management policy?
Yes. Regulation 4 requires you to prepare and implement a written asbestos management plan that explains how you will manage ACMs in your building — including who is responsible, what the inspection schedule is, and how you will make information available to contractors.
